Terms of Service
Last updated October 20, 2026 · Version 2026-10-20
The short version (please read)
- We are only a referral service. Precision Auto Leads connects drivers with independent mechanics, detailers and dealers. We do not repair, detail, inspect, sell, buy or finance vehicles, and we are not a party to any deal between a driver and a provider.
- Providers are independent businesses, not our employees or agents. We do not run background checks or verify licenses, insurance, skills or work quality. Check them yourself.
- Drivers pay providers directly. Drivers never pay us to request service. Providers pay us a fee to accept a job. Fees are non-refundable except as described below.
- Ask a Mechanic answers are general information, not a diagnosis. For anything that affects safety (brakes, steering, tires, fuel leaks, warning lights), stop driving and have the vehicle inspected in person.
- THE SERVICE IS PROVIDED "AS IS." OUR TOTAL LIABILITY IS LIMITED to the greater of what you paid us in the last 12 months or $50, and we are not liable for damage to vehicles, property, injuries, or anything a provider or driver does.
- YOU RELEASE US from claims about dealings between drivers and providers, and you agree to indemnify us if your actions cause a claim.
- DISPUTES GO TO BINDING INDIVIDUAL ARBITRATION, NOT COURT. YOU WAIVE CLASS ACTIONS AND JURY TRIALS. Small-claims court is allowed. You can opt out of arbitration by emailing us within 30 days (see Section 23).
- You must bring any claim within one year. West Virginia law applies.
This summary is for convenience. The full terms below control.
1. Agreement to these Terms
These Terms of Service (the "Terms") are a binding legal agreement between you and Weed Wrangler Land Services LLC, a West Virginia limited liability company (WV entity ID 628454), doing business as Precision Auto Leads, Friendly, WV 26146 ("Precision Auto Leads," the "Company," "we," "us" or "our"). They govern your access to and use of precisionautoleads.com, ridgelinehomeservices.com, any related websites, web apps, installable apps, emails, provider portal, Ask a Mechanic, car-buying and selling requests and every other product or service we offer (together, the "Service").
By checking a box that says you agree, clicking or tapping a button to submit a request, sign up, accept a job or pay, creating an account, or otherwise using the Service, you agree to these Terms, our Privacy Policy and, if you are a provider, the Provider Agreement, all of which are incorporated by reference. If you do not agree, do not use the Service.
"Driver" means anyone who requests service, asks a question, or asks about buying, selling or trading in a vehicle. "Provider" means any mechanic, repair shop, mobile mechanic, detailer, body, tire or diesel shop, dealership or other business or individual that signs up to receive job requests. "User" or "you" means any Driver, Provider or visitor. If you use the Service for a business, you agree to these Terms for that business and promise you have authority to bind it.
SECTION 23 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION AND JURY TRIAL WAIVER THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is offered only in the 48 contiguous United States and the District of Columbia. You may not use the Service if we have previously suspended or removed you, or if using it would violate any law that applies to you. You promise that all information you give us is true, accurate, current and complete, and that you will keep it that way.
3. What We Are, and What We Are Not
Precision Auto Leads is only an online venue and referral service. We let Drivers describe what they need and let independent Providers choose whether to accept those requests. That is all we do.
We are not a repair shop, mechanic, detailer, body shop, towing company, inspector, motor vehicle dealer, broker, auctioneer, lender, insurer, warranty company or employer. We do not perform, supervise, direct, control, inspect, schedule, price or guarantee any work, and we do not buy, sell, list, finance, title or transfer any vehicle.
We are not a party to any agreement, estimate, quote, work order, sale, trade, warranty or other transaction between a Driver and a Provider (a "Service Contract"). Each Service Contract is solely between the Driver and the Provider. Price, scope of work, scheduling, parts, payment, warranties, cancellations and everything else about the work are decided only by the Driver and the Provider. Drivers pay Providers directly; payment for the work never passes through us.
Any matching, ranking, distance, "available today," "top rated," "online," auto-assignment or similar feature is provided for convenience only. It is not a recommendation, endorsement, referral of quality or guarantee of any Provider.
4. Providers Are Independent Businesses
Providers are independent businesses and contractors. They are not our employees, agents, partners, joint venturers or representatives, and nothing in these Terms creates any of those relationships. Providers decide whether to accept a job, how and when to do the work, what to charge, what tools, parts and helpers to use, and whether to offer any warranty. We do not control and are not responsible for any Provider's acts or omissions. No Provider has authority to make any promise or bind us in any way.
5. No Vetting, Background Checks, License or Insurance Guarantee
WE DO NOT CONDUCT BACKGROUND CHECKS, CRIMINAL RECORD CHECKS, OR IDENTITY CHECKS ON PROVIDERS OR DRIVERS, AND WE DO NOT VERIFY ANY PROVIDER'S LICENSES, CERTIFICATIONS, PERMITS, INSURANCE, BONDING, TRAINING, EXPERIENCE, REVIEWS, PRICES OR CLAIMS. Any review step we take before showing a public profile is limited and done only for our own purposes. It is not an endorsement or a check of skill, honesty, legal compliance or safety.
Each Provider is solely responsible for holding and keeping current every license, registration, certification, permit, bond and insurance policy required by law or reasonably needed for its work (including any motor vehicle dealer, repair facility, environmental, and business licenses), for the quality, safety and legality of its work and parts, for any warranties it gives, for collecting and paying all taxes, and for complying with every law that applies to it. Drivers are solely responsible for deciding whether to hire a Provider. We strongly encourage Drivers to check licenses, insurance, references and reviews, get a written estimate before work begins, and never pay in full before the work is done.
6. Driver Responsibilities and Assumption of Risk
As a Driver, you agree that you choose any Provider at your own risk and that you are solely responsible for your decisions, your vehicle, your property, and your dealings with any Provider. You should remove valuables from your vehicle, provide a safe place for any mobile work, keep children and pets away from work areas, and confirm price, scope and timing with the Provider before work begins.
YOU UNDERSTAND THAT VEHICLE REPAIR, MAINTENANCE, DETAILING, TEST DRIVES, INSPECTIONS AND VEHICLE PURCHASES CARRY INHERENT RISKS, INCLUDING VEHICLE DAMAGE, MECHANICAL FAILURE, FIRE, CHEMICAL EXPOSURE, PROPERTY DAMAGE, THEFT, FRAUD, PERSONAL INJURY AND DEATH. YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL OF THESE RISKS to the fullest extent permitted by law, whether caused by a Provider, another User, a third party or the condition of any vehicle or property.
7. Vehicle Damage, Property Damage, Injury and Theft
WE ARE NOT RESPONSIBLE OR LIABLE FOR ANY DAMAGE TO OR LOSS OF ANY VEHICLE, PART, PERSONAL PROPERTY, HOME, DRIVEWAY, GARAGE, WORKPLACE OR OTHER PROPERTY; ANY THEFT, BURGLARY, FRAUD, SCAM OR MISREPRESENTATION; ANY BODILY INJURY, ILLNESS OR DEATH; OR ANY OTHER HARM ARISING FROM OR RELATED TO ANY SERVICE, WORK, PARTS, ADVICE, TEST DRIVE, VEHICLE, MEETING OR TRANSACTION BETWEEN USERS, whether it happens on or off the Service, at a shop, at a Driver's home or work, on the road, or anywhere else. Any claim for such harm must be made only against the person or business that caused it and its insurer.
8. No Guarantees
We do not guarantee that: any Provider will respond, accept, arrive, finish, or do good, safe or timely work; any price shown is a quote (profile prices are starting prices set by the Provider); any Driver will answer, hire, pay, show up or be truthful; any request is real, accurate, or still wanted; or any dealer will have, sell, buy, finance or value a vehicle in any way.
FOR PROVIDERS, WE MAKE NO GUARANTEE OR PROMISE OF ANY NUMBER, VOLUME, FREQUENCY, TYPE OR QUALITY OF LEADS, JOBS, REQUESTS, CUSTOMERS, CONVERSIONS, SALES, RESPONSES, REVIEWS, RANKINGS, PROFITS OR REVENUE. A job request is a Driver's expression of interest, not a sale. Results vary and past results do not predict future results.
9. Fees, Payments and Refunds
Drivers. Requesting a mechanic, detailer or dealer through the Service is free to Drivers. Drivers pay Providers directly for any work, parts or vehicles under their own Service Contract. Ask a Mechanic is a paid feature (currently a one-time $5 fee per question, shown before you pay).
Providers. Providers pay a per-job fee to accept a job request and receive the Driver's contact information. The fee shown on the job at the time you accept is the fee that applies. Full fee, credit and refund terms for Providers are in the Provider Agreement.
Payment processing. Card payments are processed by Stripe, Inc., a third-party processor, under its own terms and privacy policy. We never receive your full card number. You authorize us and Stripe to charge the payment method you provide for every fee you agree to. You are responsible for any bank, card or currency fees.
ALL FEES ARE FINAL AND NON-REFUNDABLE, EXCEPT AS STATED IN THESE TERMS OR THE PROVIDER AGREEMENT, OR AS WE DECIDE IN OUR SOLE DISCRETION. Our current practice: (a) if a job fills or is cancelled before a Provider's payment completes, or an Ask a Mechanic question is cancelled after payment, we refund that payment; (b) a Provider may ask for a refund or replacement credit for a job whose Driver contact information is clearly invalid (for example, a disconnected phone number and bouncing email) by emailing nathan@ridgelinehomeservices.com within 7 days of accepting it; (c) if an Ask a Mechanic question is not answered within a reasonable time, we may refund it. Refunds are not given because a Driver did not answer, chose someone else, disagreed on price, or did not hire you. Any refund or credit we give once does not obligate us to give another. Please contact us before filing any chargeback; filing a chargeback for a fee you authorized is a breach of these Terms.
Promotions and credits. Free jobs, free credits, discounts and launch offers (such as "first 3 jobs free" for Providers who sign up by October 31, 2026 at 11:59 PM Eastern) have no cash value, cannot be sold, transferred or exchanged, may be limited to one per business, and may be changed, ended or revoked at any time for future use or for misuse. We may change our fees at any time going forward; changes do not affect fees already paid.
Taxes. Fees do not include taxes unless stated. Providers are responsible for all taxes on their own work and income.
10. Ask a Mechanic Is General Information Only
Ask a Mechanic answers are general, educational information written by us or by an independent mechanic who has not seen, inspected, tested or driven your vehicle and relies only on what you typed. An answer is not a diagnosis, inspection, repair recommendation, estimate, warranty or professional advice, and no mechanic-customer or professional relationship is created. Answers may be incomplete or wrong.
DO NOT RELY ON AN ANSWER FOR ANY SAFETY DECISION. If your vehicle has any issue with brakes, steering, suspension, tires, wheels, airbags, fuel or fluid leaks, smoke, overheating, burning smells, flashing check-engine or warning lights, or anything else that could affect safety, stop driving and have it inspected in person by a qualified professional. In an emergency, call 911. You use any answer entirely at your own risk, and we are not liable for any action you take or do not take because of an answer. The fee pays for a written answer only; we do not promise any particular answer, outcome or response time.
11. Buying, Selling and Trading In Vehicles
Car-buying, selling and trade-in requests are passed to independent dealers. Precision Auto Leads is not a motor vehicle dealer, broker, auction, lender or agent of any dealer or Driver. Any vehicle listing, offer, price, trade-in value, financing, rebate, warranty, history report or availability comes only from the dealer, who is solely responsible for it and for complying with all dealer, advertising, finance, title, odometer, emissions and consumer protection laws. We do not inspect, own, hold or guarantee any vehicle, title or offer. Always get a pre-purchase inspection, a vehicle history report and all terms in writing before you sign anything.
12. Communications and Contact Consent
You agree that we may contact you by email, by in-app or portal messages and, where you separately agreed on a request form, by phone, about your requests, jobs, account, payments, these Terms and the Service, and that these communications satisfy any legal requirement that they be in writing. Providers agree to receive job alerts and service emails. You can opt out of marketing emails at any time using the link or by emailing nathan@ridgelinehomeservices.com; service and transactional messages may still be sent while you have an active request or account.
Text messages. We do not currently send text (SMS) messages. If we ever offer text messages, we will ask for your separate, express consent first, describe the program, frequency and costs, and honor STOP and HELP replies. Consent to texts is never a condition of purchase. Any texts a Provider sends you are sent by that Provider, not by us.
When you submit a request, you authorize us to share it, including your contact information, with the Provider(s) described on the form (the Provider you pick, or up to 3 matched local Providers), who may contact you about it. Providers are responsible for their own calls, texts and emails.
13. Accounts and Security
You are responsible for everything that happens under your account, sign-in link, private job or status link, or password, and for keeping them confidential. Private links (such as /job/… status pages and emailed reply links) let anyone who has the link see that page, so do not share them. Tell us right away at nathan@ridgelinehomeservices.com if you think your account or a link has been misused. We may require you to verify your identity or email. One Provider profile is allowed per phone number.
14. Your Content and Reviews
"User Content" means anything you submit, post, upload or send through the Service, including requests, questions, messages, reviews, ratings, business profiles, photos, logos, prices and descriptions. You keep ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free, fully paid, perpetual, irrevocable, transferable and sublicensable license to host, store, copy, use, display, publish, distribute, adapt, translate, modify (for formatting or length), and create derivative works from it, in any media, to operate, improve and promote the Service. You waive any moral rights in it to the extent allowed by law.
You promise that you own or have the rights to your User Content, that it is accurate and lawful, and that it does not infringe or violate anyone's rights. Reviews must reflect your real, first-hand experience. We may, but have no duty to, monitor, edit, hide, refuse or remove any User Content at any time for any reason. We are not responsible for User Content, and opinions in it are not ours.
15. Prohibited Conduct
You agree not to: (a) give false, misleading or someone else's information, or submit fake, test or prank requests; (b) use the Service for anything illegal, fraudulent, harmful, threatening, harassing, discriminatory, obscene or defamatory; (c) post fake, paid, incentivized or retaliatory reviews, or review your own business or a competitor; (d) scrape, crawl, copy, harvest or bulk-download data, profiles or contact information, or use bots or automated tools without our written permission; (e) resell, rent, share, or use for marketing any Driver or Provider information you get from the Service, except to handle that specific request; (f) send spam or unwanted calls, texts or emails, or violate the Telephone Consumer Protection Act, CAN-SPAM or similar laws; (g) interfere with, hack, probe, overload, reverse engineer or bypass any security, payment, rate-limit or access control of the Service; (h) upload viruses or malicious code; (i) create more than one Provider profile, share an account, or impersonate any person or business; (j) avoid or try to avoid fees as described in the Provider Agreement; (k) infringe anyone's intellectual property, privacy or publicity rights; or (l) help anyone else do any of these things.
16. Our Intellectual Property; Copyright Complaints
The Service, including its software, design, text, graphics, logos, the name Precision Auto Leads and all related trademarks, is owned by us or our licensors and protected by law. We give you a limited, revocable, non-exclusive, non-transferable license to use the Service only as these Terms allow. Any feedback or suggestions you send us may be used by us freely without any obligation to you.
Copyright (DMCA) notices. If you believe material on the Service infringes your copyright, email nathan@ridgelinehomeservices.com with the subject "DMCA Notice" and include: your physical or electronic signature; a description of the copyrighted work; the exact URL or location of the material; your name, address, phone number and email; a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We may remove material and terminate repeat infringers. Counter-notices may be sent the same way and must meet the requirements of 17 U.S.C. § 512(g).
17. Third-Party Services and Links
The Service may use or link to third-party services (such as Stripe for payments, email providers, maps and directions, Meta/Facebook, and Provider websites). We do not control and are not responsible for them, their content, availability, security or practices, and your use of them is governed by their own terms. Any link is not an endorsement.
18. Suspension and Termination
We may, at any time, in our sole discretion, with or without notice and for any reason or no reason, refuse service to anyone, and suspend, limit, hide, remove or terminate any account, profile, request, review, job, credit or access to all or part of the Service, including for suspected fraud, complaints, low ratings, inactivity, chargebacks, legal risk, or breach of these Terms. We may also change, pause or discontinue any part of the Service. We are not liable to you or anyone for any of these actions. You may stop using the Service at any time and may ask us to close your account by emailing nathan@ridgelinehomeservices.com. Unused free credits end when an account ends. Sections that by their nature should survive termination will survive (see Section 29).
19. DISCLAIMER OF ALL WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND EVERYTHING ON OR THROUGH IT (INCLUDING ALL PROVIDERS, DRIVERS, REQUESTS, LEADS, JOBS, PROFILES, PRICES, REVIEWS, ASK A MECHANIC ANSWERS, DEALER OFFERS, DISTANCES, MAPS, ALERTS, AUTO-ASSIGNMENTS AND OTHER CONTENT) ARE PROVIDED "AS IS," "AS AVAILABLE" AND "WITH ALL FAULTS," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, WORKMANLIKE PERFORMANCE, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE OR FREE OF VIRUSES, THAT MESSAGES, ALERTS OR EMAILS WILL BE DELIVERED, OR THAT ANY DEFECT WILL BE CORRECTED. WE MAKE NO WARRANTY ABOUT ANY PROVIDER, DRIVER, VEHICLE, PART, SERVICE, ADVICE OR TRANSACTION. NO ADVICE OR INFORMATION, ORAL OR WRITTEN, CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.
Some states do not allow the exclusion of certain implied warranties, so some of these exclusions may not apply to you; in that case they apply to the fullest extent permitted.
20. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW: (A) IN NO EVENT WILL PRECISION AUTO LEADS, WEED WRANGLER LAND SERVICES LLC, OR ANY OF ITS MEMBERS, MANAGERS, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SUCCESSORS OR ASSIGNS (THE "COMPANY PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR OPPORTUNITIES, LOSS OF USE OF ANY VEHICLE, RENTAL OR TOWING COSTS, OR COST OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY; (B) THE COMPANY PARTIES ARE NOT LIABLE FOR ANY DAMAGES, LOSS OR INJURY ARISING FROM THE ACTS, OMISSIONS, WORK, PARTS, ADVICE, VEHICLES OR CONDUCT OF ANY PROVIDER, DRIVER, DEALER OR OTHER THIRD PARTY, OR FROM ANY SERVICE CONTRACT; AND (C) THE COMPANY PARTIES' TOTAL, CUMULATIVE LIABILITY FOR ALL CLAIMS OF ANY KIND ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (1) THE TOTAL FEES YOU ACTUALLY PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (2) FIFTY U.S. DOLLARS ($50).
THESE LIMITS APPLY TO EVERY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, WARRANTY OR OTHERWISE, AND EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
These limits are an essential part of the bargain between you and us; without them we could not offer the Service free to Drivers or at these fees to Providers. They do not limit liability that cannot be limited by law (for example, in some states, for gross negligence, willful misconduct, or death or personal injury caused by our own negligence).
21. RELEASE
BECAUSE WE ARE NOT INVOLVED IN DEALINGS BETWEEN USERS, YOU, TO THE FULLEST EXTENT PERMITTED BY LAW, RELEASE AND FOREVER DISCHARGE THE COMPANY PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS AND EXPENSES OF EVERY KIND, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY INTERACTION, COMMUNICATION, SERVICE CONTRACT, WORK, PAYMENT, VEHICLE, DISPUTE OR TRANSACTION BETWEEN YOU AND ANY PROVIDER, DRIVER, DEALER OR OTHER USER OR THIRD PARTY. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law of any other state.
22. INDEMNIFICATION
You agree to defend, indemnify and hold harmless the Company Parties from and against any and all claims, demands, lawsuits, actions, investigations, damages, losses, liabilities, judgments, settlements, fines, penalties, costs and expenses (including reasonable attorneys' fees, expert fees and court and arbitration costs) arising out of or relating to: (a) your use or misuse of the Service; (b) your User Content; (c) your breach of these Terms, the Provider Agreement or any law; (d) any Service Contract, work, parts, advice, vehicle, payment or transaction you are part of; (e) any injury, death, property or vehicle damage, theft or loss involving you; (f) your calls, texts or emails to any person; or (g) your violation of anyone else's rights. We may take over the defense of any matter at your expense, and you will cooperate with us. You may not settle any matter that involves us without our written consent.
23. DISPUTE RESOLUTION: BINDING ARBITRATION, CLASS ACTION WAIVER AND JURY TRIAL WAIVER
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION AND LIMITS HOW YOU CAN SEEK RELIEF.
(a) Informal resolution first. Before starting arbitration or a small-claims case, you and we agree to try to resolve any dispute informally for at least 30 days. Send a written notice by email to nathan@ridgelinehomeservices.com (or, from us, to the email on your account) with your name, contact information, a description of the dispute and the relief you want.
(b) Agreement to arbitrate. Except as stated in (e) and (g), any dispute, claim or controversy arising out of or relating to these Terms, the Provider Agreement, the Privacy Policy, the Service, any fee, or your relationship with us, including whether a claim is subject to arbitration (each a "Dispute"), will be resolved exclusively by final and binding arbitration, not in court. This applies to claims that arose before you agreed to these Terms. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs this Section.
(c) Rules and forum. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules for Disputes with Drivers or other consumers, and its Commercial Arbitration Rules for Disputes with Providers or other businesses, as modified by this Section (available at adr.org). A single arbitrator will decide the Dispute. The arbitration will be held by video, phone or written submissions where the rules allow; any in-person hearing will take place in the West Virginia county where our principal office is located, or another place we both agree to (for consumers, a location reasonably convenient to you if the AAA rules require it). Fees are paid as the AAA rules provide; for consumer claims, we will pay any fees the AAA Consumer Rules require the business to pay. The arbitrator may award only individual relief, and only to the extent needed for your individual claim, and must follow these Terms, including the limits in Sections 19 to 22. Judgment on the award may be entered in any court with jurisdiction.
(d) CLASS ACTION WAIVER. YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS MEMBER OR REPRESENTATIVE IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS OR REPRESENTATIVE ACTION OR PRIVATE ATTORNEY GENERAL PROCEEDING. The arbitrator may not consolidate more than one person's claims. If 25 or more similar Disputes are filed by or with the help of the same law firm or group, they may be administered in batches under the AAA mass-arbitration procedures, and the statute of limitations is paused for claims waiting in a batch.
(e) Small claims and injunctive relief. Either party may instead bring an individual claim in small-claims court in the West Virginia county where our principal office is located, or in the county where you live, if it qualifies and stays there. Either party may also ask a court for an injunction to stop infringement or misuse of intellectual property, or unauthorized access to or scraping of the Service.
(f) JURY TRIAL WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL IN ANY DISPUTE. If any Dispute proceeds in court for any reason, it will be decided by a judge only.
(g) 30-day right to opt out. You can opt out of this arbitration agreement by emailing nathan@ridgelinehomeservices.com within 30 days after you first agree to these Terms, with the subject "Arbitration Opt-Out" and your name, the email and phone you use with the Service, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms, including the jury trial waiver, the one-year limit, and the choice of law and venue.
(h) Severability of this Section. If the class action waiver in (d) is found unenforceable for any claim, that claim (and only that claim) must be severed and decided in court, after all arbitrable claims are decided, and the rest of this Section still applies. If any other part of this Section is found unenforceable, the rest stays in effect. If we change this Section in the future, you may reject the change by emailing us within 30 days, and the prior version will continue to apply to you.
24. One-Year Time Limit to Bring Claims
TO THE FULLEST EXTENT PERMITTED BY LAW, ANY CLAIM OR CAUSE OF ACTION YOU HAVE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CLAIM AROSE, OR IT IS PERMANENTLY BARRED.
25. Governing Law and Venue
These Terms and any Dispute are governed by the laws of the State of West Virginia, without regard to conflict-of-law rules, and, for Section 23, by the Federal Arbitration Act. Subject to Section 23, any court action (including to enforce or vacate an award) must be brought only in the state courts of the West Virginia county where our principal office is located, or the United States District Court for the Northern District of West Virginia, and you and we consent to their personal jurisdiction and venue. Nothing here takes away any non-waivable right you have under the consumer protection laws of your own state.
26. Changes to the Service and These Terms
We may change these Terms at any time. We will post the new version here and update the "Last updated" date and version, and, for material changes, we may also notify you by email or in the Service. Changes take effect when posted (or on the date stated) and apply going forward. Your continued use of the Service after a change, or your agreement on a later request, sign-up or job acceptance, means you accept the changed Terms. If you do not agree, stop using the Service. Changes to Section 23 are subject to Section 23(h).
27. Force Majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, weather, fire, flood, pandemic, war, terrorism, riots, government action, labor disputes, power, internet, hosting, email, payment-processor or telecommunications failures, cyberattacks, or failures of third-party services.
28. Electronic Agreement and Signatures
You agree that checking a box, clicking or tapping a button, or using the Service is your electronic signature and has the same effect as a handwritten signature, under the federal E-SIGN Act and West Virginia's Uniform Electronic Transactions Act. You consent to receive these Terms, notices, receipts and other records electronically. We keep a record of the version of the Terms you agreed to, when, and the IP address it came from. You can print or save these Terms at any time from this page.
29. General Terms
Entire agreement. These Terms, the Privacy Policy, the Provider Agreement (for Providers) and any terms shown at checkout are the entire agreement between you and us about the Service and replace any prior agreements or statements. Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the rest will remain in full effect. No waiver. Our failure or delay in enforcing any provision is not a waiver. Assignment. You may not assign or transfer these Terms or your account without our written consent; we may assign them freely, including in a merger, sale of assets or change of control. Survival. Sections 3 to 11, 14, 16 and 18 to 29, all payment obligations, and every provision that by its nature should survive, survive any termination. No third-party beneficiaries, except the Company Parties as stated. Relationship. No agency, partnership, joint venture, employment or franchise relationship is created. Interpretation. Headings are for convenience only; "including" means "including without limitation." If there is a conflict, the Provider Agreement controls for Provider matters. Notices to us must be sent by email to nathan@ridgelinehomeservices.com; notices to you may be sent to the email you gave us or posted in the Service.
